Shortly before the present war broke out,

an agreement was reached between the British Government and Germany as to the definitions of "Enemy" "Ease" and "Fortified place" as used in the Declaration of London Arti-

cle 54. A draft Protocol was drawn up containing the re-

sult of the agreement, and it was proposed to sign it after

ratification of the Declaration.

As appears in my telegram of August 27th, His Majesty

by Order-in-Council dated 20th August has decided that the

British Government shall be bound by the conditions of the

Article referred to in conducting Raval operations in this

war; and it is therefore desirable that in Prise cases the

The substance of it is

"Enemy" in the phrase "Supplies of articles of
